Article 1 – Quote

The quote, unless otherwise agreed, is free of charge and without obligation. It is valid for a period of 90 days. The quote is as precise as possible, specifying the price, delivery times, and services provided. Payment terms are also specified.


Article 2 – Quote and Order

Acceptance of the quote, in any form whatsoever, without reservation of these general terms and conditions of sale, binds both parties. The quote will only be validated upon express order and payment of the deposit or the total amount of the order. Calame reserves the right to postpone the assignment if the client does not provide, within the agreed timeframe, the documents or information necessary for its completion. Postponement does not mean cancellation of the assignment nor reimbursement of the deposit or agreed amount.


Article 3 – Payment

The vast majority of services are paid for before execution of the order, except where explicitly agreed otherwise between Calame and the client. In the event of late payment, Calame reserves the right to apply a penalty of 10% on the outstanding amount. Invoices are paid by bank transfer.


Article 4 – Withdrawal

The client has a right of withdrawal of two weeks. In such case, deposits will be refunded to the client. However, Calame informs the client that, in the event of an urgent request, the assignment is considered to have begun and is therefore payable in full, even within the two-week period following the signing of the agreement.


Article 5 – Execution Time

The time frame for completion of the work is that stated in the quote. In the event of illness of one of its writers, and after informing the client, Calame reserves the right to postpone the assignment for a reasonable period. Calame cannot be held responsible for voluntary or involuntary delays in the transmission of information by its clients. In such cases, Calame cannot be held responsible for non-compliance with deadlines.


Article 6 – Invoice

Each service gives rise to the issuance of an invoice, VAT included.


Article 7 – Delivery of Work

The delivery method of the service is agreed upon between Calame and its client. Any reservations following delivery must be made within 72 hours; beyond this period, the service shall be deemed fully satisfactory.


Article 8 – Possible Modifications of Work

The detailed quote defines the assignment entrusted to the CALAME team. If the client wishes for additional adjustments not initially planned at the start of the assignment, a new quote for additional services will be issued. Calame may make readjustments after delivery of the work at the client’s request. Requests for adjustments must be made within 72 hours. Possible adjustments shall in no case concern the structure of the work delivered.


Article 9 – Termination

Any termination by the client during the execution of the contract must be made by registered letter with acknowledgment of receipt, no later than seven days before the scheduled delivery date. It is agreed that if the client terminates the agreement before any execution begins, Calame shall retain 25% of the deposit paid.

If termination occurs once work has already begun, Calame shall retain the full amounts paid by the client.


Article 10 – Client Responsibility

The client is responsible for the accuracy of the data and information provided for the execution of the work.


Article 11 – Obligation of Means

Calame is bound by an obligation of means and not of result. If necessary, Calame shall conduct the necessary research to carry out the agreed services. Calame’s liability is limited to the amount of the order.

Calame cannot be held responsible for problems related to possible file conversions between different software versions, incompatibilities, or Internet network malfunctions.


Article 12 – Ownership of Work

The work and copyrights remain the property of Calame until full payment of the amounts due by the client.


Article 13 – Confidentiality

Calame guarantees full confidentiality of the assignment and non-disclosure of its clients’ details to third parties.


Article 14 – Claims and Disputes

These general terms and conditions of sale are subject to Belgian law.
In the event of dissatisfaction, the client shall contact Calame within 72 hours. An amicable solution will always be sought. Failing agreement between the parties, the courts of Brussels shall have sole jurisdiction to settle any dispute.
